General terms and conditions Kapperssolden.be I. OFFERS All offers are made by Shops4youonline BV, the parent company of Kapperssolden.be. If the VAT rate is changed by the government in the meantime, we will adjust the VAT rates accordingly. In our websites, mailings and other offers, the articles and services offered are depicted and described as clearly and truthfully as possible. Despite all our efforts, errors may have crept into our offer. However, we cannot be held liable for the consequences of typesetting, printing or typing errors, deviations in images or interim changes to designs. We are entitled to change our conditions after the expiry of the term of an offer. Our offers on our websites are aimed at the National and International market. II. ORDERING You can order from us on the websites. In case of incomplete or unclear orders, we reserve the right not to deliver. Orders are processed in order of receipt and delivered while stocks last. We reserve the right to refuse an order, to limit the amount thereof or to attach conditions to the delivery. If requested, we will inform you of the reason for this. A payment term of up to 30 days is maintained for every order for which no specific payment method is indicated. III. DELIVERY & TRANSPORT The method of transport is determined exclusively by us. Delivery takes place via our specialized transport company within 14 days, but always no later than 1 month after receipt of your order and payment, unless the article is not (any longer) in stock or in case of force majeure. If an article is not (any longer) in stock, you will be notified. An article that is not in stock will be delivered as soon as it is available again, without additional costs, unless it concerns a joint order. If, due to circumstances beyond our control, items or replacement items can no longer be delivered, your order will be cancelled and you will be informed of this. If, due to reasons beyond our control, items can no longer be delivered, we will in certain cases deliver replacement items with the same or better properties at the same or a lower price. Orders will be sent to the delivery address you entered. Upon delivery to your address, we reserve the right to have your identity checked using your identity card or a similar proof of identity. After you have received the items, the risk of loss and damage is transferred to you. Under no circumstances can we be held liable for damage caused by failure to deliver (on time). Items are delivered by us in the packaging provided by the manufacturer or importer, to the door of the specified delivery address or in accordance with further instructions on our website. IV. COOLING-OFF PERIOD & RETURNS You have a cooling-off period of 14 calendar days, starting on the day after receipt of your order. During the cooling-off period, you are entitled to assess the ordered items for quality and execution, for example by checking whether the delivered item is in accordance with the offer. However, if you use the items during the cooling-off period in such a way that they are damaged, install or activate software or if the items show signs of use or - in general - if the use during the cooling-off period results in the items not being offered "as new" by us after they have been returned by you, we cannot accept these items for return. Any costs for repair or to restore the items to new condition will be deducted from the amount to be refunded without prior notice. The costs of the return shipment are at your expense. Special attention to scissors. As you know, scissors are very fragile. If you wish to return scissors, you must report this to customer service immediately upon receipt; +32 (0)3 304 82 77, we will then assess whether you can still return the scissors. Upon return to us, the scissors will be assessed by an expert. The expert's assessment will determine whether you will receive the amount paid back. We apply these strict rules because the manufacturer/supplier also imposes this on us. Scissors are vulnerable when used improperly, but also when dropped. If you wish to make use of the cooling-off period, you must return the delivered items undamaged - with all accessories supplied - and in the original packaging, unused and sufficiently stamped, together with a copy of the invoice, to us within 30 calendar days of receipt. Returns will then be at your expense and risk. The amount paid for the returned products (provided they are undamaged, unused and complete) and also the shipping costs of delivery to you, will then be fully refunded to you. If you no longer have the original packaging in which we sent you the items (including protective parts such as air cushions, foam plates and the like), you must notify us in writing before returning the items to us. The costs for missing packaging or damage attributable to this will be deducted from the amount to be refunded without prior notice. It is of course not permitted to stick stickers or the like on the original packaging of the products and/or to write on the products, or to make the packaging unsaleable in any other way. Any complaints about deliveries must be submitted in writing (by e-mail) within 7 calendar days of receipt of the items. The delivered items remain our property until they have been paid for in full. V. PAYMENT All our invoices are payable in cash. You can pay with your order or upon delivery. If you wish to pay with your order, you must transfer the amount due - including the associated shipping and administration costs - to our bank account. Payments are made via MultiSafepay, AfterPay or PayPal. If goods are delivered without advance payment, our invoices must be paid within 30 days. We would appreciate it if you would keep us informed of any changes of address. If you do not send a change of address, you will be deemed to reside at the last address known to us. If the payment term is exceeded, interest of 1% per month, as well as € 12.50 per reminder, will be due by operation of law and without notice of default on all outstanding and unpaid amounts. In the event of late payment, the entire balance due can be claimed, increased by compensation of 15% on the outstanding balance with a minimum of € 49.50 and this without prejudice to our right to claim the actual administrative and collection costs and legal costs incurred, as well as default interest of 1% per month commenced. Payments made will first serve to settle all interest, administration costs, collection costs and compensation due. Only after payment of these amounts will any payment be deducted from the principal amount. We reserve the right to review the financial interest. If we grant a deferment of payment for commercial reasons, this does not apply if you have payment arrears or are negligent with regard to any other obligations to us. If you have already been granted a deferment of payment, this right will lapse and the amount will become immediately due and payable as soon as your account with us shows a payment arrears. If you have paid amounts for articles in advance, we guarantee you a refund within 30 days after you have returned the articles in question to us. The accuracy of all amounts stated by us is deemed to be established, unless you have notified us in writing of any alleged inaccuracies within 1 month of receipt. When paying by credit card, the end user automatically enters into an agreement with Shops4youonline BV. When paying via PayPal, the end user automatically enters into an agreement with our parent company, Shops4youonline BV. VI. WARRANTIES All electrical and electronic items that we offer have a one (1) year warranty, unless the manufacturer or importer prescribes a different warranty period. If more extensive warranties are granted for certain items, these will be mentioned in the description of the item in question. This warranty includes repair or complete replacement of the defective item in case of manufacturing errors. Repair or replacement will be at our discretion. To make use of the warranty, you must return the item, as well as the original of your invoice to us, stating your complaint. Returns during the warranty period are at your own expense. You must contact us before returning the item. The costs of returning the device to you after are at the expense of Shops4youonline. Your warranty will lapse in the event of damage resulting from incorrect use or negligent maintenance, improper use, (over)heating by heating sources or exposing an item to moisture, extreme heat, cold or dryness, if repairs or actions have been carried out on the item by unauthorised persons, or if the items have been used for purposes other than those for which they were supplied, such as for professional or commercial purposes, or damage resulting from external calamities, such as fire, lightning, natural disasters, etc. Also excluded from the warranty are parts that need to be repaired or replaced as a result of normal wear and tear. For repair requests outside the warranty, you can contact us in advance. We are not liable for damage suffered by you or a third party as a result of using an item supplied by us, unless the damage was caused by our intent or gross negligence. Nor are direct or indirect costs or damage caused by an item being out of use eligible for compensation, unless caused by our intent or gross negligence. VII. PRIVACY Your data is stored in an external database and used for internal, automated processing in the context of responsible customer management and our business operations, such as: Processing orders, as well as sending our own offers. We do not provide data to third parties that affect your personal privacy. You naturally have the right to access and improve your data. If you do not wish to receive any other offers from us, you can inform us of this in writing (e-mail is sufficient). VIII. RETURN OBLIGATION Not applicable IX. MISCELLANEOUS If you are entitled to a free gift without purchase obligation, this remains your property in any case, even if you decide to return your order. The delivery period for gifts is a maximum of two months after your order, or - if you do not order - after the closing date of the campaign. If a gift can unexpectedly no longer be delivered, you will receive a similar gift of at least equal value. We are not liable for cases of coincidence or force majeure. In these cases, the mutual obligations are suspended if these circumstances persist for more than one month. In case of disputes, Dutch law applies.
